Adverse Possession of Part (AP)
The Adverse Possession of Part legal indemnity insurance policy provides cover against third party claims to ownership and/or unknown adverse rights and/or unknown restrictive covenants which may affect garden land which is held by adverse possession and is used ancillary to a residential dwelling.
The garden land held by adverse possession must be unregistered, enclosed and used ancillary to a single residential dwelling. The majority of the land, including the site of the building(s), must be held with absolute title, whether registered or unregistered.
The policy does not cover any claim arising from the Insured or any person on the Insured’s behalf making an application to the Land Registry for registration of title to the adversely possessed land without the Insurer’s prior written consent.
